Terms of Service

These Terms of Service (“Terms”) govern your use of the SkipType macOS app and the services we run at skiptype.ai (together, the “Service”). The Service is operated by Facula LLC (“SkipType,” “we,” or “us”). By downloading the app, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 13 years old to use SkipType (16 in the EU, EEA, and UK). If you’re under the age of majority where you live, you may need a parent or guardian’s consent.

2. Your account

To use the Service you sign in with Google or Apple. You’re responsible for keeping that underlying account secure and for anything that happens under your SkipType account. If you think someone else has accessed it, contact us at harryzhang@facula.tech.

The desktop app authenticates with a long-lived bearer token issued after web sign-in. Treat that token like a password: keep it on your device, don’t share it, and sign out if you give up the device.

3. What SkipType does

SkipType is a dictation tool. You speak, we transcribe and optionally clean up the text, and the result is pasted where you were typing. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Service for that purpose. The Service is currently macOS only.

4. Your content

You own what you say and what you write. SkipType claims no ownership over your audio, your transcripts, or the cleaned-up text we return. We only need a limited license to process your audio and text in order to deliver the Service to you — send it to our transcription and language-model providers, return the result, and discard it.

We do not use your dictation audio or transcripts to train AI models. Our third-party providers are configured for zero retention of the content we send them. See the Privacy Policy for details.

You’re responsible for the content you dictate. Don’t use SkipType to capture other people’s speech without their consent, and don’t dictate anything you don’t have the right to write.

5. Output is not guaranteed accurate

Speech recognition and language models make mistakes. SkipType produces output based on what it heard and how the model interpreted it — we make no representation that the result is accurate, complete, or appropriate for any particular use. Read what gets pasted before you send it, especially in contexts where mistakes matter.

6. Things you can’t do

When using SkipType, please don’t:

— Reverse-engineer, decompile, or attempt to extract source code or model weights from the Service, except to the extent the law allows.
— Probe, scan, or otherwise interfere with the security or integrity of the Service, including by overwhelming it with automated traffic.
— Use the Service to generate content that exploits or endangers minors, incites violence, or violates someone else’s rights.
— Resell, sublicense, or redistribute access to the Service without our written permission.
— Use the Service to record other people’s speech without their consent, where consent is required by law.
— Use the Service’s output to train competing AI models, or to falsely claim a person, brand, or model generated, endorsed, or approved it.

7. Beta features

Parts of SkipType are clearly labeled as beta or experimental. They may break, change, or disappear. Don’t rely on them for anything load-bearing.

8. Third-party services

SkipType relies on third parties to do its job — Google and Apple for sign-in, AI service providers for speech-to-text transcription and the language-model formatter, Stripe for payments, and infrastructure providers like Vercel and our database host. Their actions and outages are governed by their own terms, and we’re not responsible for what happens on their side.

9. Our intellectual property

The SkipType name, logo, app, website, and the code and design behind them are ours (or our licensors’). These Terms don’t give you any right to use them beyond running the app. If you send us feedback, we can use it without owing you anything.

10. Changes to the Service

SkipType is an early product and will keep changing. We may add, remove, or modify features, change pricing, or shut things down. Where a change materially reduces what you can do, we’ll try to give reasonable notice.

11. Billing and subscriptions

SkipType has a free tier with a weekly word quota. The Pro plan lifts that quota and is offered on a monthly or yearly cadence; the current price for each is shown on the website and in the app. Subscriptions are billed through Stripe; by subscribing you also agree to Stripe’s terms. Pro renews automatically until you cancel it from the customer portal we link to from the app or from the account page. Cancellation takes effect at the end of the current billing period — you keep Pro access until then. We don’t offer prorated refunds for partial billing periods, but if something on our end went obviously wrong, email us and we’ll make it right.

We may change prices at any time. If a change affects an existing subscription, we’ll give reasonable notice before the next renewal and you can cancel before being charged at the new rate. Taxes, if applicable, are added on top of the listed price.

12. Termination

You can stop using SkipType at any time and delete the app. We may suspend or terminate your account if you breach these Terms, if continued use poses a risk to other users or to us, or if your account has been inactive for a long time. Sections about ownership, disclaimers, liability, and dispute resolution survive termination.

13. Disclaimer of warranties

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee the Service will be uninterrupted, error-free, or secure, or that output will be accurate. Where the law gives you statutory rights that can’t be disclaimed, those rights still apply.

14. Limitation of liability

To the maximum extent permitted by law, SkipType isn’t liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption arising from your use of the Service. Our total liability for any claim relating to the Service is limited to what you paid us in the twelve months before the claim — for free-tier users, that amount may be zero.

Nothing in these Terms limits liability that can’t legally be limited (for example, for fraud, gross negligence, or death or personal injury caused by negligence).

15. Indemnification

You agree to indemnify and hold SkipType harmless from claims arising out of your breach of these Terms, your content, or your misuse of the Service, except to the extent the claim is caused by us.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute that can’t be resolved informally will go to the state or federal courts located in San Francisco County, California, and you and we consent to the personal jurisdiction of those courts. If you live somewhere with mandatory consumer-protection rules that override this section, those rules apply.

17. Changes to these Terms

We may update these Terms from time to time. If a change materially reduces your rights, we’ll give reasonable notice — for example, by email or in the app — before it takes effect. Continuing to use the Service after the new Terms take effect means you accept them.

18. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and SkipType about the Service. If any part is unenforceable, the rest still applies. Our failure to enforce a provision isn’t a waiver of it. You can’t assign these Terms; we may assign them to an affiliate or successor in connection with a merger, acquisition, or sale of assets.
